These terms govern your use of the NM Clerks Election Calendar, an educational and instructional reference for New Mexico county election administration. By using this site, you agree to these terms.

1. Purpose of the service

The site helps county clerks and authorized staff:

  • View citation-backed election deadlines and planning anchors.
  • Prepare county-specific election information through guided workflows.
  • Generate printable handouts for candidates, voters, and the public.
  • Manage staff access within a county where permitted.

The service is for education, training, and operational reference. It is not a filing system, case management system, or substitute for the New Mexico Secretary of State, the Election Code (NMSA 1978), or your county attorney.

2. Not legal advice

Content on this site, including summaries, calendars, citations, and handout templates, is provided for convenience and instruction only. It may not reflect the latest statutory amendment, rule, or SOS publication.

You are responsible for verifying dates, forms, and procedures against official sources before taking action in your official capacity. When in doubt, consult your county attorney or the Secretary of State.

3. Eligibility and accounts

  • Access is limited to people with a legitimate need to support county election operations in New Mexico.
  • Accounts are individual. Do not share sign-in links or credentials.
  • Access requests are reviewed manually. We may approve, deny, or revoke access at our discretion.
  • You must provide accurate information when requesting access or maintaining your profile.

4. Acceptable use

You agree not to:

  • Use the site for any unlawful purpose or in violation of election law.
  • Attempt to access another county’s data or another user’s account without authorization.
  • Probe, scrape, or overload the service; bypass security or rate limits.
  • Upload malicious code or misleading content intended to disrupt the service.
  • Present generated handouts as official Secretary of State or county legal documents when they are summaries.

5. County data and handouts

  • County clerks and authorized editors are responsible for the accuracy of county-specific data they publish (contacts, locations, ballot items, and local notes).
  • Handouts include citations and disclaimers by design. You must review each handout before distribution to the public.
  • Publishing county profile changes may be logged for audit purposes.

6. Forms and external links

The form registry lists Secretary of State and related forms with citations. URLs may be added when official links are published. We do not guarantee that every form link is current. Always confirm the form version on the SOS website before use.

7. Intellectual property

Site software, layout, and curated instructional structure are owned by the operator or licensors. Statutory text and official SOS materials remain subject to their own terms and public-law status. You may use generated handouts for legitimate county election purposes; do not resell or misrepresent them as proprietary legal products.

8. Availability and changes

We may modify, suspend, or discontinue features with or without notice. Maintenance, outages, and data errors may occur. We strive for reliability but do not guarantee uninterrupted access.

9. Disclaimer of warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT CONTENT IS COMPLETE, CURRENT, OR ERROR-FREE.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE OPERATOR AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, REVENUE, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100) OR THE AMOUNT YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE CLAIM, WHICHEVER IS GREATER.

Some jurisdictions do not allow certain limitations; in those cases, the above limits apply only to the extent allowed by law.

11. Indemnity

You agree to indemnify and hold harmless the operator from claims arising out of your misuse of the service, your county-published content, or your violation of these terms, except to the extent caused by our gross negligence or willful misconduct.

12. Governing law

These terms are governed by the laws of the State of New Mexico, without regard to conflict-of-law rules. Disputes will be brought in state or federal courts located in New Mexico, unless otherwise required by law.

13. Privacy

Our Privacy policy describes how we handle personal information. It is incorporated into these terms by reference.

14. Changes to these terms

We may update these terms. The “Last updated” date will change when we do. Material changes may be noted on the site. Continued use after changes take effect constitutes acceptance.
